Terms and Conditions

1. About these terms

These Terms and Conditions (“Terms”) govern your access to and use of the Arete application and website (“Service”) operated by MUDr. Marek Filippi, IČO 19579446 (“we”, “us”, “Arete”). By creating an account, using the Service, or purchasing any product, you agree to these Terms in full. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use Arete. Users aged 13 to 17 must have verifiable parental or guardian consent. By using the Service, you represent that you meet these requirements. We reserve the right to terminate accounts where this cannot be confirmed.

3. Your account

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and current information during registration.
• You must notify us immediately at hello@getarete.eu if you suspect unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. The Service

Arete is an athletic health and performance tracking application. It allows users to log fitness and health metrics, receive scored assessments benchmarked against population data, and track performance over time. The Service is provided across web and iOS platforms.

Certain features are marked as “coming soon” and are not yet available. We make no guarantees as to the timing of their release.

5. Not medical advice

Arete is an informational tool only. The scores, benchmarks, and assessments provided by the Service are for general informational and personal tracking purposes. Nothing in the Service constitutes medical advice, diagnosis, or treatment. Do not make medical decisions based solely on information provided by Arete. Always consult a qualified healthcare professional for medical guidance.

6. Plans, pricing, and payment

6.1 Available plans

• Free assessment: available without an account. Provides access to domain scores and limited number of metricsfrom a single assessment.
• Pro subscription (monthly): provides full access to all domain scores, unlimited history, trend tracking, unlimited reassessments.
• Pro subscription (annual): same as monthly Pro, billed annually at a discounted rate.
• Single report (one-time): provides full access to all domain scores from one assessment. Does not include progress tracking or reassessments.
• Lifetime access (limited availability): where offered, provides permanent access to all Pro features.

6.2 Payment

All payments are processed by Stripe. Prices are displayed in USD and may vary by region due to applicable taxes. By providing payment details, you authorise us to charge the applicable fees. All sales are final unless otherwise stated in these Terms.

6.3 Subscriptions and cancellation

Subscriptions renew automatically at the end of each billing period. You may cancel at any time via your account settings or by contacting hello@getarete.eu. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused periods unless required by applicable law.

6.4 Price changes

We reserve the right to change prices at any time. Existing subscribers will receive at least 30 days' notice before any price increase takes effect. Founding member rates, where applicable, are locked in for the duration of active continuous subscription.

7. Refunds

As a consumer in the EU, you have a 14-day right of withdrawal from the date of purchase for digital services not yet fully performed. By starting to use the Service immediately after purchase, you expressly request early access and acknowledge that the right of withdrawal may be lost once the service has been fully performed. 8. Anonymous assessment sessions

You may use the free assessment without creating an account. Your session data is stored temporarily for 30 days. If you create an account within this period, your assessment data will be linked to your account automatically. After 30 days, anonymous session data is permanently deleted and cannot be recovered.

9. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Reverse engineer, decompile, or otherwise attempt to extract source code
• Scrape, harvest, or collect data from the Service using automated means
• Submit false, misleading, or fraudulent data or account information
• Use the Service to transmit malware, spam, or other harmful content
• Resell, sublicense, or commercially exploit the Service without written permission

10. Intellectual property

All content, design, code, benchmarking methodology, scoring algorithms, and branding within Arete are the property of MUDr. Marek Filippi and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes only.

You retain ownership of the data you input into the Service. By submitting data, you grant us a limited licence to process it for the purposes of providing the Service as described in our Privacy Policy.

11. Limitation of liability

To the fullest extent permitted by applicable law, Arete and MUDr. Marek Filippi shall not be liable for:

• Any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service
• Loss of data, loss of profits, or business interruption
• Any decisions made based on information or scores provided by the Service
• Temporary unavailability of the Service due to maintenance, technical issues, or force majeure

Our total liability to you for any claim arising under these Terms shall not exceed the total amount paid by you to us in the 12 months preceding the claim. Nothing in these Terms limits liability that cannot be excluded under Czech law, including liability for death or personal injury caused by negligence.

12. Service availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. We may suspend, modify, or discontinue all or part of the Service at any time with reasonable notice. In the event of material permanent discontinuation, Pro subscribers will receive a pro-rata refund for the unused portion of their current billing period.

13. Termination

You may delete your account at any time via account settings. We may suspend or terminate your account without notice if you materially breach these Terms, engage in fraudulent activity, or if required by law. Upon termination, your licence to use the Service ceases immediately and your data will be deleted in accordance with our Privacy Policy.

14. Governing law and disputes

These Terms are governed by the laws of the Czech Republic. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of the Czech Republic.

If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or prominent in-app notice at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. The current version is always available at getarete.eu/terms.
